Delhi High Court Refrains From Interfering With TRAI's Penalty Recommendation

The Delhi High Court today refrained from directing the Centre or any other authority not to act upon TRAI’s recommendation to impose Rs. 1,050 crores penalty on Vodafone for not providing interconnectivity to Reliance Jio as no one except the regulator was a party in the case.

“How can I stop anyone else or the Union government from acting on the recommendation when they are not before this court? I will make the government a party and will issue notice to it. Its presence is necessary,” the judge said and listed the matter for hearing on January 3 next year.

The order came after Vodafone, represented by senior advocate Rajiv Nayar, claimed that Reliance Jio (RJio) has gone to the Competition Commission of India (CCI) with the recommendation made by the Telecom Regulatory Authority of India (TRAI) and sought that the other authorities be restrained from acting upon the regulator’s suggestion.
During the hearing, the court said it was of the prima facie view that TRAI seems to be only a recommendatory body or a wing of the government from which the government takes advice and thus, under their internal mechanism they may follow a procedure as per law or as they deem fit.

It also said that in communications between two departments of the government, the court cannot interfere.
TRAI, represented by senior advocate Meet Malhotra and advocate Kirtiman Singh, on the other hand, contended that it was not required to give a hearing to Vodafone before it gave its recommendation and admitted that no such hearing was given to the telecom major.

Malhotra also told the court that when Vodafone and other private telecom companies had first entered the Indian market, the state telecom companies, MTNL and BSNL, “had also adopted similar tactics” of not providing interconnections and then also TRAI had taken similar steps.

TRAI also said that apart from its recommendation, it had also given a direction to all service providers to comply with the licence conditions and this has not been challenged.

TRAI has recommended imposition of a fine of Rs. 50 crores for each of the 21 circles of Vodafone, except in Jammu and Kashmir, coming to a total of Rs. 1,050 crore.

The company is touting a battery life up to 11.5 hours. It comes with an HDMI port, two USB 3.0 ports, a USB Type-C port, and a 3.5mm headphone jack.

The 13.3-inch Mi Notebook Air on the other hand comes with a sixth-generation Intel Core i7 (2 cores, 4 threads, max clock speed of 3.0GHz) processor, which the company says will provide a 10 percent improvement over the Core i5 processor of the non-4G variant. Other specifications remain the same as last time, including a Nvidia GeForce 940MX GPU with 1GB of GDDR5 VRAM, 8GB of DDR4 RAM, and a 256GB PCIe SSD.

Just like the 12.5-inch model, a second SSD slot on the 13.3-inch Mi Notebook Air 4G can be used for expansion. As before, the new 4G variant is touted to deliver a battery life up to 9.5 hours. Other connectivity, ports, and audio options are the same as the 12.5-inch model. It weighs 1.28kg and is 14.8mm thick.

Samsung launched the Pink Gold variant of its smartphone Galaxy S7 Edge in April earlier this year. Now, the South Korean company has finally brought this colour variant to India. The pricing of the phone has been kept unchanged at Rs. 50,900.

In terms of specifications, the Samsung Galaxy S7 Edge features a 5.5-inch Super Amoled display with QHD (1440×2560 pixels) resolution. The phone is powered by an octa-core Exynos 8890 SoC coupled with 4GB of RAM.

The always-on display on the Galaxy S7 Edge allows users to check notifications, time, and date without waking up the device. The phone features a 12-megapixel ‘Dual Pixel’ rear camera with an f/1.7 aperture and smart OIS feature, as well as a 5-megapixel front camera with f/1.7 aperture.

Ashley Madison Dating Site to Pay $1.6 Million Over Data Breach

The operators of the Ashley Madison affair-minded dating website agreed Wednesday to pay a $1.6 million (roughly Rs. 10 crores) penalty over a data breach exposing data from 36 million users, US officials announced.

The settlement comes after a hacker group last year released what was said to be personal data on millions of members of Ashley Madison, who were based in 46 countries. The fallout led to reports of blackmail and even suicides.

The financial penalty, split between the federal government and US states suing the company, would increase to $8.75 million to the FTC plus $8.75 million to states if Ashley Madison fails to abide by new information security practices and refrain from misleading consumers.

“This case represents one of the largest data breaches that the FTC has investigated to date, implicating 36 million individuals worldwide,” said FTC chairwoman Edith Ramirez.
“The global settlement requires to implement a range of more robust data security practices that will better protect its users’ personal information from criminal hackers going forward.”

No compensation
Ramirez said the penalty being paid is too small to allow for “redress” or compensation to affected consumers, noting that compensation is rarely obtained in data security cases.

“We want them (the company) to feel the pain, we don’t want them to profit from unlawful conduct,” Ramirez told reporters in a conference call.

But she added that “it would not serve the public interest to put them out of business.”
Earlier this year, the dating website – whose motto had been “life is short, have an affair” rebooted, calling itself an “open-minded dating” service.

The company said at the time it will no longer use female “bots” or automated programs that respond to members pretending to be women on the hunt for men.

According to the FTC complaint, until August 2014, operators of the site lured customers, including 19 million Americans, with fake profiles of women designed to convert them into paid members.

The company failed to adequately protect users’ personal information such as date of birth, relationship status and sexual preferences, according to the complaint.

The company confirmed the settlement, saying it would help it move past the hacking episode.

“Today is a pivotal day for our members and for Ashley Madison,” said a statement from Ruby chief executive Rob Segal.

“Today’s settlement closes an important chapter on the company’s past and reinforces our commitment to operating with integrity and to building a new future for our members, our team and our company.”

The settlement followed an investigation in cooperation with consumer protection authorities in Canada and Australia. Thirteen US states plus the federal District of Columbia joined the lawsuit.

Zuk Edge Launch Now Set for Tuesday; New Leaked Images Surface

Zuk has finally confirmed that the much-anticipated Edge smartphone will be launching on Tuesday – December 20. The company shared a teaser on Weibo showing the upcoming Zuk Edge partially with an interface layout that seemed focused for the Chinese market. To recall, the company was expected to launch the Zuk Edge last week – but that did not happen.

The Zuk Edge smartphone is likely to pack 32GB and 64GB inbuilt storage options, and have the fingerprint scanner as well (presumably under the Home Button at the bottom of the display).

On the camera front, the Zuk Edge smartphone is rumoured to sport a 13-megapixel rear camera and an 8-megapixel camera at the front. Zuk Edge is said to run Android 6.0 Marshmallow with ZUI 2.0 skin, and is expected to pack a 3000mAh battery. An earlier report tipped that the Zuk Edge may be priced at CNY 2,699 (roughly Rs. 26,800).

The Zuk Edge will be Lenovo’s fourth Zuk-branded smartphone. To recall, Lenovo has so far launched the Zuk Z1 (launched in August last year), Zuk Z2 Pro (launched in April this year), and Zuk Z2 (launched in May this year).

In separate news, a White-coloured smartphone believed to be the Zuk Edge has been spotted in live images. The smartphone packs slim bezels around the display and also sport a home button placed right below the display.

Evernote Employees Can Read Your Notes, Highlights New Privacy Policy

Evernote has issued a notice to announce that it will allow a few employees to access users’ notes to look after the machine learning technologies applied to content. Starting from January 23, a select set of employees will gain access to all users’ data to ‘help you get the most out of your Evernote experience’. While this change is new, further investigation reveals that some employees have had access for a while – for legal reasons.

The company adds that these few employees who have access to user data are “subject to background checks and receive specific security and privacy training at least annually to ensure they are up to date on the latest privacy and security requirements and standards.”

Users can opt out of machine learning if they so desire by heading to Account Setting and unchecking the ‘Allow Evernote to use business data to improve my experience’ box. However, Evernote adds that employees can still peek into your content even after you opt out of machine learning experience. It says. “And please note that you cannot opt out of employees looking at your content for other reasons stated in our Privacy Policy (under the section, “Does Evernote Share My Personal Information or Content?”).” According to the policy provision, Evernote needs to do this to prevent fraud, illegal activities, and recognise threats.

9to5Mac notes that these other reasons in the Privacy Policy has been around for some time, but was only brought to light because of this January announcement. Thus, while users can opt out of machine learning, they cannot opt out of this privacy policy accessing of data.

In any case, this means that while you can stop Evernote from sifting through your data for better machine learning experiences, there is no way you can stop the employees from regularly accessing your data for legal reasons.
